小白第一次买房,一不小心把down的比例写成了24%。。。。 现在想改成20%,不知道还需不需要通知下卖家或者重发offer之类的。
严格的说,financial contingency的条款里并没有说不能改dp比例,只有改lender和loan type必须要重新签合同。下面是华州22A
Waiver of Financing Contingency. If Buyer
(i) fails to make application for financing for the Property within the agreed time;
(ii) changes the type of loan at any time without Seller’s prior written consent; or
(iii) changes the lender without Seller’s prior written consent after the agreed upon time to apply for financing expires,
then the Financing Contingency shall be deemed waived.
但是在实操当中,最后贷不下来,如果中间下调过dp比例的话,上庭对buyer不利,需要lender出面作证贷不下来和dp比例完全无关才行,但这几乎是不可能的。
